Civil Litigation in Fort Bend

Texas Attorneys at Law

In the court of law there are many key differences between legal cases, one large distinction is the divide between civil and criminal cases. The distinction typically involves damages to a private party vs. a violation to society as a whole that puts others in danger, or is otherwise harmful. In addition, civil cases are typically brought against defendants by another person or corporation. Criminal cases are typically pursued by the government on behalf of the people, as with any criminal act the one being accused is the one who put the public in harm’s way.

Civil Litigation Process

The civil litigation process begins much like a divorce, as there are contested and uncontested cases when filing for a civil case. When there is an uncontested civil case, this means that both parties agree to the violation and outcome of the case as a whole. Before these uncontested agreements can be finalized they must first be sanctioned by a judge and moved through the courts.

On the other hand, civil disputes more commonly result in contested cases that involve a legal courtroom discussion on the various aspects of the case. The case will then be settled in the favor of one of the parties that are involved in the civil discussion. Civil litigation cases go through three phases, including: pre-trial, discovery, and then motions. If none of these are enough to resolve the case, then the case will go into trial and post-trial, where one of the parties will receive the more favorable verdict.
