Two Separate Charges Under Texas Law

Texas treats vehicle theft under two distinct statutes, and the difference between them matters significantly for how a case is charged and defended.

Under Texas Penal Code Section 31.03, auto theft occurs when a person unlawfully appropriates a vehicle with the intent to deprive the owner of it. The prosecution must prove not only that the defendant took the vehicle without consent, but that they intended to permanently deprive the owner, whether by selling it, abandoning it, or keeping it. That intent element is the core of the charge.

Texas Penal Code Section 31.07 covers unauthorized use of a vehicle, a distinct offense that applies when someone intentionally or knowingly operates another person’s motor vehicle without the owner’s effective consent. This charge doesn’t require intent to keep the vehicle. A person who borrowed a car and planned to return it can still face this charge if they lacked valid permission to use it.

Effective consent under Texas law means consent freely given by someone authorized to grant it. Consent obtained through deception or intimidation doesn’t qualify, which is why seemingly informal arrangements can still result in a criminal charge.

Penalties for Vehicle Theft & Unauthorized Use in Texas

For theft under Section 31.03, the charge level scales with the vehicle’s value:

  • Under $2,500: Generally a misdemeanor, unless the defendant has prior theft convictions
  • $2,500 to $30,000: State jail felony, carrying up to two years in state jail and a fine of up to $10,000
  • $30,000 to $150,000: Third-degree felony, carrying two to 10 years in prison
  • $150,000 and above: Second-degree or first-degree felony, with prison terms reaching 20 years, or life for the highest-value cases

Unauthorized use of a vehicle under Section 31.07 is a state jail felony regardless of the vehicle’s value. The penalty range runs from 180 days to two years in state jail, plus a fine of up to $10,000. Texas courts can grant probation for this charge, and judges may accept deferred adjudication, which keeps a conviction off a defendant’s record if conditions are met.
